TURBO8 TERMS AND CONDITIONS OF USE

Her Majesty the Queen in Right of Canada, as represented by the Minister of Industry through the Communications Research Centre Canada ("Copyright Holder") provides the Turbo8 Design and Simulation Tool (Software) for evaluation and non-commercial use under the terms and conditions specified below:

• The Software was created in the course of research endeavours and not as a commercial package. Its present version (which may still be in development) is distributed "as is, with all defects". By using the software, the User agrees to assume all responsibility and risk for any and all such use. No warranty, condition, or representation of any kind, express or implied, is made about the Software, including without limitation any warranty of title, noninfringement, merchantability, or fitness for a particular purpose, by the author(s) or by the Copyright Holder.
  
• Independent of the foregoing disclaimer of warranties, the User agrees that the Copyright Holder shall not be liable for any incidental or consequential damages concerning the use of the Software, including without limitation lost profits or injury to business.
  
• The User agrees to indemnify, defend, and hold the Copyright Holder harmless against any loss, expense, claim, damage, or liability of any kind arising from or connected with its use of the Software.
